1. Acceptance of Terms
Welcome to Givore. These Terms of Service ("Terms") govern your use of the Givore mobile application and related web services (collectively, the "App"), operated by Karol Dąbrowski, acting as a self-employed sole proprietor (autónomo) registered in Spain under NIE ESZ0649598Z, with operating location in Valencia, Spain ("we," "us," or "our"). The trading name of the service is "Givore".
By downloading, installing, registering for, or otherwise using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App. Your registration constitutes acceptance of these Terms; we record the version of these Terms that was in force at the time of your registration.
2. Description of Service
Givore is a free-giveaway community platform that allows registered users to:
- Share items they have found in public places, to make them easier for others to retrieve
- Post items they are looking for, and receive notifications when matching items are posted nearby
- Give away items they no longer need
- Connect with other registered users to coordinate the no-charge transfer of those items
All items shared through Givore are offered free of charge. Givore is not a marketplace; it does not facilitate sales, rentals, or paid services. Givore is designed to promote sustainability and community sharing.
2.1 Intermediary Hosting Provider
Givore acts solely as an intermediary hosting provider for user-generated content. We do not pre-screen, endorse, verify, or guarantee user submissions. We do not warrant the accuracy, lawfulness, ownership status, condition, or safety of any item that any user describes or offers. Where we operate moderation processes (see §6), those processes are performed for the limited purposes of enforcing these Terms and the Community Guidelines and do not constitute legal review, ownership verification, authenticity verification, safety inspection, or any approval of legality of user content.
Givore is a hosting provider within the meaning of the EU Digital Services Act (Regulation (EU) 2022/2065). We operate the notice-and-action mechanism described in §7 below to comply with Article 16 of that Regulation.
3. Eligibility
To use the App, you must:
- Be at least 14 years of age, which is the digital-consent age in Spain under Article 7 of Organic Law 3/2018 (LOPDGDD); we recognise that local digital-consent ages differ, and the higher of 14 and your local digital-consent age applies if you are outside Spain
- Have the legal capacity to enter into these Terms (which for minors of digital-consent age and above includes the supervision of a parent or guardian as required by local law)
- Not be prohibited from using the App under any applicable law
- Not have had your account previously terminated by us for a violation of these Terms, unless we expressly reinstate it
If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App. We do not knowingly collect personal information from users below the applicable digital-consent age. If you believe a minor below that age has registered, please contact [email protected].
4. Account Registration
To access certain features of the App, you must create an account. You may register using:
- Email and password
- Sign in with Google (OAuth)
- Sign in with Apple (on iOS)
You agree to:
- Provide accurate and complete information during registration
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorised use of your account
- Be responsible for all activities that occur under your account
4.1 Acceptance audit trail
When you register, we record (a) the timestamp of your registration, (b) the IP address from which you registered, and (c) the version of these Terms that you accepted. This record is retained to demonstrate consent under Article 7(1) of the GDPR and may be produced in connection with a dispute or regulatory request.
5. User Conduct & Prohibited Content
You agree NOT to use the App to:
- Post false, misleading, or fraudulent content; misrepresent yourself, your location, or the items you offer
- Share illegal items or items that promote illegal activities
- Harass, abuse, intimidate, threaten, or harm other users; engage in hate speech or discrimination
- Post content that is sexually explicit, obscene, gratuitously violent, or otherwise inappropriate for a general-audience community
- Post or solicit any content that sexualises minors, depicts child abuse, or attempts to groom minors
- Use the App for commercial purposes, to sell items, or to advertise goods or services for compensation
- Spam, flood, or post repetitive or off-topic content
- Attempt to gain unauthorised access to the App, other users' accounts, our systems, or third-party systems
- Use automated systems, bots, scrapers, or harvesters to access the App, except as expressly permitted by our published machine-access policies (llms.txt, robots.txt)
- Violate any applicable law, regulation, or third-party right
- Infringe the intellectual property rights of others
- Impersonate another person or entity
- Publish other people's personal information without their consent (doxxing)
5.1 Prohibited items
You may not post, list, offer, solicit, or arrange the transfer of any of the following items via the App. This list is non-exhaustive and is mirrored in our Community Guidelines, which are incorporated into these Terms by reference:
- Weapons, ammunition, replicas, and items intended primarily as weapons
- Illegal drugs, drug paraphernalia, and recreational substances
- Prescription medication and regulated medical devices
- Recalled or unsafe products; items with known defects creating safety risks
- Perishable food without clear expiry dates; opened or expired food
- Live animals (pets, livestock, wildlife)
- Hazardous materials (chemicals, solvents, fuels, asbestos, lead-based paint, damaged batteries, fireworks, restricted pesticides)
- Counterfeit goods and items presented as authentic when they are not
- Stolen goods or goods of unclear provenance
- Items that require CE marking, professional certification, or safety inspection, shared without that certification (e.g., infant car seats, motorcycle helmets, climbing equipment, electrical installations)
- Tobacco, vaping products, and alcoholic beverages
- Adult or sexually explicit content or services
- Illegal or unlicensed services, services requiring professional licensing
- Personal data, identity documents, financial credentials, or account credentials of any kind
- Items advertised for sale, exchange for payment, or paid services of any kind
6. User Content
6.1 Ownership
You retain ownership of the content you post on the App, including photos, descriptions, comments, and messages ("User Content").
6.2 Licence Grant
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, transmit, adapt (for technical purposes such as resizing or transcoding), and distribute that User Content solely for the purpose of operating, maintaining, securing, and improving the App and its underlying services, including for moderation, abuse prevention, backups, and analytics performed by us or on our behalf.
This licence does not extend to:
- training third-party AI models on User Content,
- selling or transferring User Content to third parties outside the operational scope above, or
- any use after the User Content has been deleted, except as required for legitimate purposes such as backups, dispute resolution, fraud prevention, or legal compliance.
Public marketing content authored by Givore on givore.com is separately authorised for AI training as described in our llms.txt; this is editorial content authored by us, not User Content.
6.3 Content Responsibility
You are solely responsible for your User Content. We do not endorse or guarantee the accuracy, truthfulness, completeness, or legality of any User Content, and we are not liable for any User Content posted by users. You represent and warrant that you have the right to post your User Content, that it does not infringe any third-party right, and that posting it is lawful in the jurisdiction from which you post and the jurisdiction in which the item is located.
6.4 No ownership or transfer-rights verification
Givore does not verify ownership, transferability, legality, or abandonment status of items posted by users. You are solely responsible for confirming that an item you offer is yours to give away, that you have the legal authority to transfer it, and that giving it away is lawful where you are. This is particularly important for items found in public or private spaces, where many municipalities consider abandoned items to belong to the municipality or the original owner until a finder's-rights process is completed.
6.5 Illegal disposal and waste-law compliance
Users are solely responsible for ensuring that items posted are legally transferable, lawfully possessed, and compliant with local waste-disposal, hazardous-material, recycling, and property laws. The App is not an alternative to municipal waste-collection services and must not be used to dispose of construction debris, demolition materials, hazardous waste, regulated electronics, or any item that local law requires to be handled through a specific waste-collection channel.
6.6 Content Removal
We reserve the right to remove any User Content that violates these Terms, the Community Guidelines, or applicable law, and to suspend or terminate the accounts of users responsible for that content. Where we remove content following a report from another user or from a third party (notice-and-action under DSA Art. 16), we will notify the user whose content was removed and provide a statement of reasons in accordance with DSA Art. 17, except where doing so would be prohibited by law or compromise an investigation.
6.7 Repeat-infringer policy
We may suspend or permanently terminate the accounts of users who repeatedly violate intellectual property rights, the Community Guidelines, or these Terms. We keep internal moderation records sufficient to enforce this policy.
7. Reporting Illegal Content (DSA Art. 16 notice-and-action)
Inside the App, every post, profile, comment, idea, image, and chat element has a Report option. Reports go to our moderation team for review. Anyone may also report illegal content to us by email at [email protected] with subject line "Illegal content notice".
A complete notice should include:
- A sufficiently substantiated explanation of why the content is alleged to be illegal
- A clear indication of the exact location of the content (URL, post ID, profile, or screenshots)
- The notifier's name and email (unless the notice concerns offences listed in Articles 3 to 7 of Directive 2011/93/EU)
- A statement of good-faith belief that the information provided is accurate and complete
We aim to acknowledge receipt without undue delay and to take an appropriate, diligent, non-arbitrary, and objective decision in due time. For copyright complaints specifically, please use the same address with subject line "Copyright takedown notice".
8. Transactions Between Users
Givore facilitates connections between users but is not a party to any transaction or exchange between users. We are not responsible for:
- The quality, safety, condition, or legality of items posted
- The accuracy of item descriptions, photographs, or stated locations
- The ability of users to complete handovers
- Any disputes between users
- Any physical harm, property damage, or other loss arising from a meeting or handover
Users interact and exchange items at their own risk. We encourage users to exercise caution and meet in safe, public locations.
9. Third-Party Services
The App integrates with third-party services, including Sign in with Google and Sign in with Apple (account authentication), Google Maps (location features), Google Analytics and PostHog (analytics), Sentry and Firebase Crashlytics (error monitoring), and Google Gemini API (AI-assisted features). Your use of these services is subject to their respective terms and privacy policies. A complete list of the third parties that process Givore user data on our behalf is published at /sub-processors.
10. Intellectual Property of Givore
The App, including its design, features, logos, branding, illustrations, and content authored by us (excluding User Content), is owned by Karol Dąbrowski / Givore and protected by intellectual property laws. You may not:
- Copy, modify, or distribute the App
- Reverse-engineer, decompile, or disassemble the App, except where such restriction is prohibited by mandatory applicable law
- Use the Givore name, logo, or other trademarks without our prior written permission
- Create derivative works based on the App
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. For account deletion and data-removal requests, see our Data Removal page.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:
- Merchantability and fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of content (including User Content)
- Uninterrupted or error-free operation
Nothing in this section limits any mandatory consumer-protection rights you may have under the law of your habitual residence.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Personal injury or property damage resulting from your use of the App or from any handover arranged through the App
- Any conduct or content of third parties on the App, including other users
Our total liability shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim. Nothing in this section limits any liability that cannot be excluded under mandatory law, including liability for gross negligence, wilful misconduct, or harm caused to consumers under Spanish or EU consumer law.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the App
- Your violation of these Terms or the Community Guidelines
- Your User Content
- Your violation of any third-party right or applicable law
15. Termination
We may suspend or terminate your account at any time, with or without cause, with or without notice — for example in case of repeated or serious violations of these Terms or the Community Guidelines, or where required by law. You may delete your account at any time through the App settings or by following our Data Removal procedure.
Upon termination:
- Your right to use the App will immediately cease
- We may delete or anonymise your account and User Content in accordance with our Privacy Policy
- Provisions that by their nature should survive termination (e.g., §6.2 licence for residual operational uses, §13 limitation, §14 indemnification, §17 governing law) will remain in effect
16. Changes to Terms
We may update these Terms from time to time. Where an update is material — for example, where it introduces a new processing purpose, a new sub-processor, or a change in jurisdiction — we will notify registered users by an in-app announcement and/or by email and will require an explicit acknowledgement before continued use. For non-material clarifications, we will update the "Last Updated" date on this page and your continued use of the App after the change constitutes acceptance.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
18. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of Poland.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with the closest enforceable provision that reflects the original intent.
20. Entire Agreement
These Terms, together with our Privacy Policy, Community Guidelines, and Sub-processors page, constitute the entire agreement between you and us regarding the use of the App.
