1. Acceptance of Terms

Welcome to Givore! These Terms of Service ("Terms") govern your use of the Givore mobile application ("App") operated by Kdabrow ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Givore is a social recycling platform that allows users to:

  • Share items they have found in public places
  • Post items they are looking for
  • Give away items they no longer need
  • Connect with other users to exchange items for free

All items shared through Givore are offered free of charge. The App is designed to promote sustainability and community sharing.

3. Eligibility

To use the App, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the App under applicable laws

If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

4. Account Registration

To access certain features of the App, you must create an account. You may register using:

  • Email and password
  • Google Sign-In (OAuth)

You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

5. User Conduct

When using the App, you agree NOT to:

  • Post false, misleading, or fraudulent content
  • Share illegal items or items that promote illegal activities
  • Harass, abuse, or harm other users
  • Post content that is offensive, obscene, or discriminatory
  • Use the App for commercial purposes or to sell items
  • Spam other users or post repetitive content
  • Attempt to gain unauthorized access to the App or other users' accounts
  • Use automated systems or bots to access the App
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others

6. User Content

6.1 Ownership

You retain ownership of the content you post on the App, including photos, descriptions, and messages ("User Content").

6.2 License Grant

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the App.

6.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of any User Content and are not liable for any User Content posted by users.

6.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

7. Transactions Between Users

Givore facilitates connections between users but is not a party to any transactions or exchanges between users. We are not responsible for:

  • The quality, safety, or legality of items posted
  • The accuracy of item descriptions or photos
  • The ability of users to complete exchanges
  • Any disputes between users

Users interact and exchange items at their own risk. We encourage users to exercise caution and meet in safe, public locations.

8. Third-Party Services

The App may integrate with third-party services, including:

  • Google Sign-In: For account authentication
  • Google Analytics: For app analytics and improvement
  • Google Maps: For location-based features

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Intellectual Property

The App, including its design, features, logos, and content (excluding User Content), is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Use our trademarks without permission
  • Create derivative works based on the App

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage resulting from your use of the App
  • Any conduct or content of third parties on the App

Our total liability shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your User Content
  • Your violation of any third-party rights

14. Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. You may also delete your account at any time through the App settings or by contacting us.

Upon termination:

  • Your right to use the App will immediately cease
  • We may delete your account and User Content
  • Provisions that by their nature should survive will remain in effect

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of Poland.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
